Conditions of Entry

Entry Restrictions Open only to Australian residents aged 18 or over except directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter, or of the agencies or companies or participating storesassociated with this competition.
Competition Period 12.01am (AEST) on 04/10/12 to 11.59pm (AEDT) on 28/11/12.
Stores All BP stores in Australia.
Entry Method During the Competition Period, make a fuel or shop purchase (excluding tobacco products from a participating Store (Eligible Purchase) to receive a game card (Game Card) (subject to Game Card stocks remaining in that Store) with a 10 digit code and, either: send an SMS (maximum cost 55 cents (inc GST)) from their mobile phone to 1999 6767 stating in one message and in the following order the 10 digit code from their Game Card, their full name and postcode (errors and omissions excepted in the Promoter’s discretion); or visit www.bppromos.com.au(Website) (or scan, using a compatible mobile phone, the QR code located on the back of the Game Card) to play the online instant win scratch game by fully completing and submitting the online entry form, including by providing their full name, mobile phone number, the 10 digit code from their Game Card, their email address and any additional information as required by the Promoter.
Confirmation of Entry Entrants will receive a return SMS or online notification (at no cost to the entrant) (depending on their method of entry) confirming their successful entry into the competition and advising them whether they are an instant winner. By entering this competition, entrants consent to receiving this electronic message.
Entrants who are not instant winners will automatically be entered into the second chance draw in accordance with paragraph 6.
Bonus Online Entry Method The Promoter may, throughout the Competition Period, send existing entrants and members of its database promotional material (e.g. email) containing a bonus web code. The bonus web code can only be submitted online and will entitle the entrant to one bonus entry into the major prize draw. The bonus entry may be subject to a task being completed (e.g. a survey). The task will be determined by the Promoter in its discretion.
Instant Winners SMS entrants: If notified that they are an instant prize winner, SMS entrants must, within 5 days of receiving the notification, send their postal address to the Promoter via reply SMS (at no cost to the entrant) so that the prize can be sent to them. Failure to send their postal address to the Promoter within 5 days of receiving the winning notification, will invalidate the entry and the entrant will not be entitled to receive the prize.
Instant winners notified in accordance with Confirmation of Entry above will have their instant prize mailed out to their postal address as specified in their entry (or in the case of an SMS entrant, as specified in the reply SMS).
Instant Prize Details There are 40,000 instant prizes to be won.
Each instant prize is a $5 BP gift card. Each instant prize will be mailed out to the winner’s address (as specified by the entrant) within 5 days of being notified they are an instant winner (or in the case of an SMS entrant, within 5 days of the Promoter receiving the prize winner’s address details). The Promoter does not guarantee that instant prizes will be received by the prize winners within any specific period.
The instant prize pool is valued at $200,000.
Major Prize Details There is one major prize to be won.
The major prize is$100,000 cash awarded in the form a bank cheque.
Major Draw Details 12noon (AEDT) on 03/12/12 at Prime Focus, 403/62 Beach St, Port Melbourne VIC 3207.
Prize Pool The total prize pool is valued at $300,000.
Entry Limits Entrants may enter up to three times per person per day provided that each entry is based on a separate Eligible Purchase (in a separate transaction) and a separate 10 digit code. Any bonus entries awarded pursuant to the Bonus Online Entry section above do not count as part of the limits on entries per person per day.
Retain Receipt Requirements Entrants must retain their original Eligible Purchase receipt and their original Game Card to verify each entry in order to claim the major prize.
Winner Notification Instant winners will be notified in writing in accordance with Confirmation of Entry above.
The major prize winner will be notified by phone and in writing and will have their name and state/territory of residence published in The Australian on 10/12/12.
Second chance draw winners will be notified in writing.
Major Prize Claim Date and Time Within 3 months of the draw.
Unclaimed Prize Draw Details 12noon (AEDT)on 05/03/13 at the same location as the major draw.
Unclaimed Prize Draw Winner Notification Any winner in the Unclaimed Prize Draw will be notified by phone and in writingand will have their name(s) and state/territory of residence published in The Australian on 12/03/13.

  1. Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.

  2. SMS entry is only open to consumers with an SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. Consumers should check with their network service provider to see if their mobile phone is compatible. SMS service provider is Prime Focus, SMS queries: 1800 818 957. Entry via QR code is only available to consumers with mobile phones able to scan QR codes.

  3. All entries must be received during the Competition Period. Entries (and the additional reply SMS that SMS instant winners are required to send to the Promoter at no cost to the winners) are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the entrant. Failure of an entrant to provide their receipt/s and Game Card/s (as per the Retain Receipt Requirements) (without alteration) to the Promoter upon request may, at the Promoter’s discretion, result in an invalid entry (and, at the Promoter’s discretion, in all of the entrant’s entries being invalid). The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple email addresses or aliases may be disqualified. Consumers are responsible for their own costs associated with accessing the Internet. Automatically generated entries will not be accepted.

  4. Game Cards from any other competition are not valid for this competition. Game Cards are void if stolen, forged, mutilated or tampered with in any way.

  5. The major draw will be conducted at the time, date and location as stated in the Major Draw Details. The first valid entry randomly drawn from all valid entries received will win the major prize.

  6. Entrants who do not win an instant prize will be automatically entered into the second chance draw.

  7. The prizes are as stated in the Instant Prize Details and Major Prize Details.

  8. If an instant prize remains unwon at the end of the Competition Period, a second chance draw will take place at 12.30pm (AEDT) on 03/12/12 at the same location as the Major Draw. Each unwon prize will be distributed to the next valid second chance draw entry randomly drawn until all unwon prizes are awarded. Any winners in this second chance draw will be notified in accordance with Winner Notification above and will be sent their instant prize to the address as specified by the winner, within five days of the second chance draw.

  9. All BP gift cards are subject to the terms and conditions as imposed by the Promoter including period of validity.

  10. The winners will be notified in accordance with Winner Notification above. By entering this competition, each entrant requests that his or her full address not be published.

  11. The prize winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.

  12. The Promoter and/or any Store may require entrants or winners to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s and/or Store’s discretion.

  13. If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and, in the event of an instant winner, the instant prize will be redistributed in accordance with paragraph 8 or, in the instance of the major winner, a new major winner will be determined by drawing a further valid entry in accordance with paragraph 5.

  14. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person.

  15. The Promoter’s decision is final and no correspondence will be entered into.

  16. Prizes are not transferable or exchangeable and (except where cash is specified) cannot be redeemed for cash. If a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the gaming authorities in each state and territory if required.

  17. There will be a total of 30,000,000 Game Cards printed.

  18. Printing and other quality control errors outside the Promoter’s control will not invalidate an otherwise valid prize claim. Every prize claim in excess of the advertised prize pool will be honoured, unless such claim is rejected due to fraud or ineligibility under these conditions.

  19. If the major prize has not been accepted or claimed in accordance with the Major Prize Claim Date and Time or if, after making all reasonable attempts, the Promoter cannot contact the drawn winner (or the drawn winner does not contact the Promoter) by the Major Prize Claim Date and Time, the relevant winner’s entry will be deemed invalid and the Promoter will conduct such further draws in accordance with the Unclaimed Prize Draw Details as are necessary to distribute the major prize, subject to any requirements of the gaming authorities in each state and territory. Any winner in this draw will be notified as stated in the Unclaimed Prize Draw Winner Notification.

  20. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

  21. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.

  22. The Promoter may communicate or advertise this competition using Facebook. However, the competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability.

  23. If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory if required.

  24. The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

  25. All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. By entering this competition, entrants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future competition and marketing purposes regarding its products, including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them and obtain a copy of the Promoter’s privacy policies by visiting www.bp.com.au.
